Welcome to Winning Bids. The following Terms & Conditions apply to the services provided by Surya Interactive Services Pvt. Ltd, www.winningbids.com and its users.
The users have to agree to and accept the Terms and Conditions of Winning Bids services before creating a Winning Bids account. We strongly recommend that you read each and every point under terms and conditions carefully. The user agreement is a legally binding agreement between Winning Bids and the user.
Information on Winning Bids under Help or About us are only recommendations and are not intended as rules or guidelines. Winning Bids holds no liability or responsibility for the actions of users.
Winning Bids reserves the right to change and revise the terms and conditions at any time.
General and Scope
The general terms and conditions are exclusively for maintaining a good business relationship between Surya Interactive Services Pvt. Ltd, www.winningbids.com and the users. Becoming a member of Winning Bids, the user accepts the general terms and conditions of Winning Bids.
Winning Bids will not accept any change in terms and conditions unless the user requests Winning Bids in writing and Winning Bids responds to the request in writing whether it has accepted or not.
Any special promotions for limited time shall be valid only if they are announced on the website or published in a newsletter. The expiry dates are applicable to all promotional offers.
Use of the website:
You are solely responsible for your information and its usage on the website. It is required that you provide accurate information about yourself and that your information:
1. Shall not be false, inaccurate or misleading.
2. Shall not be fraudulent or involve in online bidding with multiple accounts.
3. Shall not infringe any third person details for online bidding.
4. Shall not be defamatory, trade libellous, unlawfully threatening or unlawfully harassing.
Participation and Disqualification:
People who are above 18 years only are eligible to participate in online bidding on Winning Bids. Employees and relatives of Surya Interactive Services Pvt. Ltd are not allowed to participate in Winning Bids services.
It is not required for users to register with “My Winning Bids” to participate in Winning Bids services. Registered users can avail of the access to “My Winning Bids” and enjoy the flexibility of Auto-bid and other Winning Bids options. Winning Bids always encourages and recommends users to register and enrich their experience.
It is mandatory that each user should register only once, providing their personal information and the residential postal address. The user is flexible to choose username of his/her choice. The username chosen should not be offensive on any grounds and must maintain standards of decency. They should not infringe or use misleading usernames, which is strictly prohibited.
Winning Bids has the right to change or delete a username if it is found to be violating Winning Bids terms and conditions. The user is strictly advised not to share his/her password under any circumstances with anyone.
The user should provide a legitimate Email ID while registering with Winning Bids to receive authentication code and other important messages. An authentication code is sent to the Email, when user enters that code his/her registration process is complete.
If a user changes his/her Email Id it is mandatory that it is updated in his / her Winning Bids account. If you do not update, you risk losing the account or cannot participate in auctions. Winning Bids tries to prevent manipulation of any kind in the online bidding process. It has the right to verify the authenticity of each online bidder. In some cases it may even ask the users to submit photo ID, proof of address and other documents. In any situation, user information is insufficient; Winning Bids has all the rights to cancel that user registration.
Winning Bids disqualifies a user or his/her winnings, if it finds that a particular user has misused the Winning Bids services or used unfair means to win in the auction. Winning Bids will either be liable for refunding any bids or any purchased products. This is to protect the right of its users and Winning Bids.
Users cannot hold Winning Bids responsible for any loss that may incur as a result of Winning Bids taking any of the actions outlined above.
Bid purchasing and payments
Winning Bids offers a variety of bid packages, each for different users. Registered users have to buy the bids or bid packages prior to online bidding on Winning Bids.
Bidding on Winning Bids.com is only open to residents of INDIA. A user who is away from India, who wishes to bid on Winning Bids, should ensure that he/she has a postal address in India. Winning Bids will deliver the won products only to the Indian Postal Address irrespective of the present residence address of that person.
It is a must that bids are purchased in advance; users can verify if the bid package they have chosen is the right one or not by verifying it three times online. Once the bid package is purchased, it is not refundable under any circumstances. Users have to decide in advance how much they are willing to spend on the bidding process.
Payments can be made through debit/credit cards. When the user purchases the bids, it is deposited into user’s Winning Bids account and a contract for the purchase is created. If the bid payment has not been honoured by the user’s financial institution, he will be liable for a charge of additional administrative costs incurred by Winning Bids.
Winning Bids reserves all rights to block the user’s access until the payment is clear with all costs incurred. All bid purchases will expire in 60 days from the day of the purchase.
Also discount offers have a time limit so they are automatically not valid after expiry date or time limit.
Disclaimer of Warranty and Liability @ Purchases from Winning Bids
All new products are sold with the manufacturer's limited warranty only. Winning Bids warrants solely that the products sold to user under these terms shall have the characteristics specified in Winning Bids specifications for such products as set forth in the description of each auction and assumes no further warranties. The warranty period and service varies by manufacturer and product. The full text of any such warranty is available, free of charge, upon written request mailed to Winning Bids. Warranty is excluded for the delivery of any used products.
EXCEPT FOR THE WARRANTIES SET FORTH ABOVE WINNING BIDS MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, OR ANY RELATED SERVICES PERFORMED BY WINNING BIDS OR ANY OF ITS AGENTS OR SUBCONTRACTORS IN CONNECTION WITH ANY ORDER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WHICH OTHER WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED.
WINNING BIDS SHALL NOT BE LIABLE FOR PERSONAL INJURY AND PROPERTY DAMAGE RESULTING FROM THE IMPROPER HANDLING, MODIFICATION, MISUSE OF THE PRODUCTS BY THE CUSTOMER OR ANY OTHER PERSON FOLLOWING DELIVERY BY WINNING BIDS. IN NO EVENT SHALL WINNING BIDS BE LIABLE TO ANY PERSON FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR GOODWILL, LOSS-OF-USE DAMAGES OR ADDITIONAL EXPENSES INCURRED, WHETHER PURSUANT TO A CLAIM IN CONTRACT, TORT OR OTHERWISE AND WHETHER IN AN ACTION FOR BREACH OF WARRANTY OR OTHERWISE.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
